These terms and conditions (the “Terms”) covers all your access to and activities during the use of HereIM mobile app (the “App”). By using the App, you are entitled to these Terms and entering a legally binding contract with electrotgeng (“ElectroTG”). Do not use the App if you are not willing to be bound by the Terms of this agreement. All referring to “you” and “your” shall refer to you as a user of the App. Any reference as “we”, “us” and/or “our” shall refer to ElectroTG.
The App uses in-app advertisements and by giving your consent to the Terms, you agree to use the App with the demonstration of these advertisements for the whole duration of your usage and/or access to all the App functionalities and to the App itself with a limited screen space due to the design of the advertisements according to the sizing rules determined by the provider of all the advertisements demonstrated.
The App needs access to Camera to use Flashlight (torch and your camera will never be used in the App), Location (GPS), Wi-Fi, Mobile Data and Contacts to provide SOS SMS preparation assistance. By consenting, you permit the app to:
- Turn on/off the device flashlight (torch),
- Read approximate/precise location to attach to SOS messages,
- Read contacts to allow selection of emergency phone numbers,
- Prepare an SOS SMS message body (with your current location).
Note that the App does not ask for file access permission as it will only be used for application related data storage.
Please read carefully. You must scroll to the bottom of this document to enable the "I CONSENT" button. Your data will never be used for any other purpose than what is defined here. The location data is needed for you to share your immediate location during an emergency to receive the support you needed.
1. By consenting, you are accepting to use the App in the way it is intended. We and/or the App are not responsible from the liabilities that may occur because of improper use of the App to prank and deceive anyone or any authority in any way possible.
2. You agree to use the App for legitimate purposes and not for any illegal or unauthorized purpose, including without limitation, in violation of any intellectual property or privacy law. By consenting to the Terms, you represent and warrant that you are at least the age of majority in your state or province of residence and are legally capable of entering into a binding contract.
3. You agree to not use the App to conduct any activity that would constitute a civil or criminal offence or violate any law.
4. We are not responsible from any harm or physical damage to user device and/or user himself/herself during the usage and/or the operation of the App. Addition, the App is not liable from the situations which limit its capabilities due to impairments of any equipment of the user device.
5. We are not responsible from any disruption of data delivery to your contacts which may be caused by unforeseen circumstances that are not connected to the App (loss of mobile data or Wi-Fi connection, loss of GPS signal, loss of cellular data from SMS service providers or wrong contact information records due to user mistake and/or any kind of unforeseen circumstances possible).
6. We reserve the right to refuse service to anyone, at any time, for any reason without justification and the right to make any modifications to the App, including terminating, changing, suspending, or discontinuing any aspect of the App at any time, without notice. We may impose additional rules or limits on the use of the App. You agree to review the Terms regularly and your continued access or use of the App will mean that you agree to any changes.
7. You agree that we will not be liable to you or any third party for any modification, suspension, or discontinuance of the App.
8. Uninstalling the app from your device or ceasing to use it does not relieve you of your obligations under this agreement. You acknowledge that your liability for all actions and misconduct performed while using the app will continue even if you delete or stop using the app.
9. Copying or selling the app without our permission is legally prohibited and all rights are reserved.
User privacy is the top priority for us. Because of this fact, the App does not implement any kind and mean of sharing user data with third parties and/or any local/remote server. The user data is used only for the favor of the user under his/her consent. This Privacy Policy explains how the App (“the App”, “we”, “our”, or “us”) collects, uses, and protects user information. By using this App, you agree to the collection and use of information in accordance with this policy.
If our privacy policies are not in agreement with your expectations, please do not use the App.
1. INFORMATION WE COLLECT
We do not keep track of any information and data related to you and your activity during the usage of the App and its services. The information and data obtained are only used for the App’s functionality to support the user during emergency situations under user’s consent without recording and/or sharing with a remote/local server. All the information is collected temporarily to support the App’s functionality.
1.1 Personal Information
The App may collect the following non-personally identifiable and personally identifiable information only when required for core functionality:
• User name (optional, provided by the user)
• Emergency contact phone numbers (selected by the user)
1.2 Location Information
The App may access device location (GPS) only when the SOS feature is activated, in order to:
• Determine the user’s approximate or precise location
• Include location information in emergency messages
Location data is not collected or used in the background unless the user explicitly triggers the SOS function.
1.3 Contacts Information
The App may access the user’s contacts list only if the user grants permission, for the purpose of:
• Selecting emergency contacts for SOS alerts
The App does not upload, store, or share the full contacts list.
2. HOW WE USE INFROMATION
The information collected is used only for the following purposes:
• To provide flashlight functionality
• To enable SOS emergency alerts
• To help user sending emergency messages (SMS) with user-approved content
• To include GPS location in SOS messages
• To store user preferences locally on the device
3. DATA STORAGE and SECURITY
• All user data is stored locally on the device
• The App does not use external servers
• The App does not sell, rent, or share personal data
• We take reasonable steps to protect user data from unauthorized access
4. DATA SHARING
We do not share personal data with third parties. Data may be shared only when explicitly initiated by the user, such as:
• Asisting the user in sending an SOS message via prefiled SMS body
5. PERMISSIONS EXPLANATION
The App may request the following permissions:
• Camera / Flashlight – to control the device flashlight
• Location – to include GPS coordinates in SOS alerts
• Contacts – to allow selection of emergency contacts
• Internet – to help with location information
• Foreground/Background Service – to keep SOS or flashlight functions active when needed
Permissions are requested only when required and can be revoked at any time through device settings.
6. USER CONTROL and DATA DELETION
Users have full control over their data:
• You can remove stored contacts within the App
• You can revoke permissions at any time
• Uninstalling the App removes all locally stored data
7. AGE SPECIFIC PRIVACY
This App is not intended for children under the age of 13. We do not knowingly collect personal information from children.
8. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time. Any changes will be reflected on this page with an updated revision date.
